This Privacy Policy explains how The Hype Group Limited, promoter of VYBZ Fest (“we”, “us” or the “Promoter”), handles personal information collected through this website and related VYBZ Fest activities. We aim to process personal data fairly, lawfully and transparently under Kenya’s Data Protection Act, 2019 and other applicable law.

1. Information we collect

  • Competition entries: your name, email address, phone number, headliner guess, submission time and prize-administration information.
  • Corporate enquiries: company name, contact name, email address, phone number, requested number of tables and your message.
  • Merchandise reservations: your name, email address, phone number, WhatsApp contact, selected item, size and quantity, and reservation status.
  • Technical and security information: limited information generated when you access the website, such as request, device, browser and security logs where our hosting providers make these available.
  • Administrator information: account and access information used to protect and operate the restricted administration area.

Ticket purchases are completed through Tickoz. This website does not collect payment-card details. Tickoz handles information submitted during checkout under its own privacy policy.

2. How we use information

We use personal information only where needed to:

  • administer EBU GUESS, check entries, rank correct guesses, contact winners and deliver prizes;
  • respond to corporate enquiries, prepare proposals and administer confirmed bookings;
  • manage merchandise stock, contact you about a reservation, and arrange payment and pickup;
  • operate, secure, troubleshoot and improve the website and prevent fraud or misuse;
  • meet legal, accounting, regulatory and dispute-resolution obligations; and
  • protect the rights, safety and property of attendees, visitors, staff, partners and the Promoter.

Depending on the context, we rely on steps requested before a contract, performance of a contract, compliance with law, our legitimate interests in operating and protecting the event and website, or consent where the law requires it.

3. No automatic marketing use

Contact details submitted for a competition, corporate enquiry or shop reservation are used for that request and related administration only. We do not add those details to a marketing list unless you separately and clearly choose to receive marketing. You may withdraw any future marketing consent at any time.

4. When we share information

We may share only the information reasonably necessary with trusted providers that help us host and secure the website, store data, operate ticketing, manage communications, fulfil reservations, provide professional advice or comply with law. This may include:

  • website, database and storage providers;
  • Tickoz for ticketing and payments when you choose to use its service;
  • WhatsApp/Meta when you choose WhatsApp for reservation communication;
  • YouTube/Google when you choose to play an embedded video; and
  • law-enforcement, regulators, courts, advisers or insurers where disclosure is legally required or reasonably necessary.

We do not sell personal information.

5. International processing

Some technology and communications providers may process information outside Kenya. Where personal data is transferred internationally, we take reasonable steps to use providers and safeguards that meet applicable Kenyan requirements, taking account of the sensitivity of the information and the service involved.

6. Retention

We keep personal information only for as long as reasonably needed for the purpose collected, to complete a competition, enquiry, booking or reservation, to resolve disputes, and to meet legal, tax, accounting or security requirements. We then delete or anonymise it where reasonably practicable. Different records may have different retention periods.

7. Security

We use reasonable organisational and technical safeguards designed to protect personal information against unauthorised access, alteration, loss or disclosure. Access to submitted competition, enquiry and reservation details is restricted to authorised administrators and service providers who need it. No internet service is completely secure, so we cannot guarantee absolute security.

8. Cookies and embedded services

The current public website does not use advertising cookies or behavioural analytics tools. Essential technical storage may be used to operate and secure the website. Embedded or linked third-party services may apply their own technologies when you interact with them. For example, playing an embedded YouTube video may allow YouTube/Google to receive device and usage information under its own policy.

9. Your rights

Subject to Kenyan law and any applicable exceptions, you may ask us to:

  • confirm whether we process your personal data and provide access to it;
  • correct inaccurate or incomplete information;
  • object to or restrict certain processing;
  • delete information that we no longer have a lawful reason to keep;
  • provide portable information where that right applies; or
  • withdraw consent without affecting processing already carried out lawfully.

We may need to verify your identity before acting on a request. You may also lodge a complaint with Kenya’s Office of the Data Protection Commissioner.

10. Children

VYBZ Fest admission is restricted to persons aged 18 and over. Our public forms are not intended for children. If you believe a child has submitted personal information, contact us so we can review and remove it where appropriate.

11. Third-party links

Our website may link to ticketing, social-media, video, messaging or other third-party services. We do not control their privacy practices. Review their policies before providing information to them.

12. Policy updates

We may update this policy when our services, providers or legal obligations change. The updated version and its date will be published on this page. Material changes will be highlighted where reasonably appropriate.
